inzpire Photography generally finishes projects within 8 weeks following either the wedding date, or the date the payment is received, whichever is later. However, inzpire Photography also reserves the right to adjust the completion date based on influx and order needs. Therefore, the Client agrees to an indefinite waiting period until the entire project is finished and able to be delivered. No refund will be given based on time required for the project to be finished, or for artistic preferences. inzpire Photography agrees to give notice of at least one week prior to shipping the project in order to receive a proper address to send the package.
Payment is to be made by cash or EFT. The first payment is a non-refundable retainer. At a minimum, Client agrees that the retainer fee fairly compensates inzpire Photography for committing to provide the Services and turning down other potential projects/clients. Final payment is due 2 weeks before the wedding date or as agreed by both parties.
For all weddings deemed as destination (taking place beyond
200 km away), additional fees are applicable, such as round trip airfare, hotel stay for 2-3 days & 1-2 nights pending complexity, and car rentals from airport and back during the stay for the inzpire Photography crew. All travel can be arranged by Client per specifications of inzpire Photography or arranged by inzpire Photography with agreement of payment invoiced.
If at the request of Client, additional unplanned or un-contracted services (such as, but not limited to, full redo of design, day of wedding extension of time, services outside of scope of agreement, management of non wedding day activities, etc) are considered overtime and will be billed with prior notification and consent at the rate of $300 per hour.
Client understands and agrees that he or she has hired inzpire Photography exclusive of any other service provider. In order to provide a high level of satisfaction and quality of service, no other service providers, other than any assistant or third party that inzpire Photography hires to complete the Services are permitted to provide the same or similar services or products, paid or unpaid, at the locations and dates specified for the wedding.
All shots desired should be given to inzpire Photography in the wedding info questionnaire (which will be given a week before wedding). inzpire Photography is not responsible for special circumstances or shots which are not included in the questionnaire.
inzpire Photography is not responsible for missing scenes due to the absence of persons who should be included in such shots or due to the failure of identifying such persons.
If inzpire Photography is at the event longer than 4 hours and food is served to the guests during the event, Client will make food available to the inzpire Photography crew.
Copyright Ownership. In the event that any copyrighted work(s) are created as a result of the Services provided, inzpire Photography owns all copyrights in any and all work(s) it creates or produces, whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling the Services, are expressly and solely owned by inzpire Photography and may be used in the reasonable course of inzpire Photography's business.
Permitted Uses of Product(s). inzpire Photography grants to the Client a non-exclusive license of product(s) produced with and for Client for personal websites, and for dispersal to family and friends. Client agrees that for any form of reproduction or public dispersal, inzpire Photography will be acknowledged. Additional rights may be granted by agreement between the two parties at that time, however they must be written and signed by both parties to be valid. Client allows inzpire Photography and his/her assigns to legally exhibit the wedding videos in portfolios, websites, commercials and competitions, as long as the Client is presented in a positive light
Style. Client has spent a satisfactory amount of time reviewing inzpire Photography’s work and has a reasonable expectation that inzpire Photography will perform the Services in a similar manner and style unless otherwise specified.
Consistency. inzpire Photography will use reasonable efforts to ensure Client's desired Services are produced in a style and manner consistent with inzpire Photography's current portfolio and will try to incorporate any reasonable suggestion made by Client. However, Client understands and agrees that:

Every client and wedding is different, with different tastes, budgets, and needs;

Videography services are often a subjective art and inzpire Photography has a unique vision, with an ever-evolving style and technique;
-
inzpire Photography will use its artistic judgment when providing Services for Client, which may not include strict adherence to Client’s suggestions;
-
Although inzpire Photography will use reasonable efforts to incorporate Client’s suggestions and desires when providing Client with the Services, inzpire Photography shall have final say regarding the aesthetic judgment and artistic quality of the Services;
-
Dissatisfaction with inzpire Photography's aesthetic judgment or artistic ability are not valid reasons for termination of Services or request of any monies returned.
Maximum Damages/Loss of Product. In the unlikely event that, by way of technical failure or an act of God, the footage is lost or tarnished beyond repair, inzpire Photography shall refund Client a pro-rated portion of the Total Cost based on the amount of Services that were completed/provided against the amount of Services that were agreed to be completed/provided. No further liability will be held by inzpire Photography. Should any of these events occur, Client agrees to full confidentiality, and agrees to not tarnish the reputation of inzpire Photography by way of any negative communication, public or private.
Failure to Perform Services. inzpire Photography is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance.
In such a situation, inzpire Photography will obtain, upon approval of the Client, a qualified professional replacement to fulfill inzpire Photography’s obligations under the contract, at no additional charge to the client. In the event inzpire Photography cannot or will not perform its obligations, it (or a responsible party) will:

Immediately give Notice to Client; and
-
Issue a refund or credit based on a reasonably accurate percentage of Services rendered; and
-
Excuse Client of any further performance and/or payment obligations.
Force Majeure. Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:
-
A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or
-
War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or
-
Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.
inzpire Photography will make every effort to ensure the final images are of high quality and represent the property in the best way. Sometimes however, an agent/homeowner may feel these images do not meet those expectations. In this case, inzpire Photography will work closely with the agent/homeowner to correct the issue and photos. A reasonable amount of re-editing will be performed at no additional cost. If a return trip is requested due to issues in the photos regarding decluttering, additional photos not specifically requested prior to shoot, or other aspects that are not directly the responsibility of inzpire Photography, there will be a charge. A minimum re-shoot fee of $70 will be charged to the agent/client, unless it is the direct responsibility of the photographer then there will not be a charge (i.e. missing specific shot requested prior to shoot).
Everyone has a different idea of their "best photo" but prior to hiring inzpire Photography, please carefully review our photo and video Gallery as there will be no refunds issued to clients who are not happy with the "style" of photography. “Style” refers to image angles, color, and any other visual aspect of the photo.
inzpire Photography is the exclusive copyright holder of the image. Full image rights are not sold or granted, clients only receive licenses. Licensing may be obtained for various applications of images, please refer to Photo Rights and Usage for Real Estate Photography.
Failure to pay for the images will result in a copyright infringement/violation. You will be required to remove the image(s) from any electronic or printed form of advertisement within 24 hours. Failure to stop using them will result in legal action.
Real Estate Photography and Videography: The original agent/client who paid for the service has permission to use the images on any electronic or printed form of advertisement for the promotion of that property. The licensing agreement is valid only for the duration the home/property is listed for sale and cannot be reused without specific written permission from inzpire Photography.
inzpire Photography must be made aware, credited, and compensated for any printed or digital publication/use where photos are not being used for the direct marketing of the sale of the property.
Agents/clients may not sell, transfer, or gift any images for any reason to any third party, especially to another agent who takes over an expired, withdrawn, or cancelled listing. These third parties also include sellers, builders, stagers, and any other contractors associated with the property or agent. ** Note that image licenses are non-transferable.
inzpire Photography reserves the right to re-license the photos.
Once photos have been delivered, the agent and/or homeowner may not make any digital alterations, editing, or use Photoshop (or similar editing tools) to edit/ change the photos unless to crop the images. If there is an issue or concern with editing or photos please contact inzpire Photography, but do not make alterations as this is a violation of copyright.
"Community shots" such as golf course, clubhouse, fitness centers, subdivision signs, etc., may be licensed in conjunction with property photos in order to market the listing. inzpire Photography retains all rights to every photo and therefore these shots are stock images. Using the photos in other marketing or in conjunction with other properties, is prohibited unless additional licensing is purchased.
By scheduling a service with inzpire Photography you agree that the property is ready for photos to be taken. You also understand that we charge a $50 service fee when we must return to a property in which it is not our fault. This includes, but is not limited to: property not ready, staging incomplete, construction, agent/owner not home, no key in lock-box, etc. This does include partial photo shoots where the exterior may not be ready or certain rooms are incomplete and the photographer is required to return.
We also understand things come up or may change but if a property is rescheduled or cancelled within 24 hours of the scheduled shoot time, there will be a $50 fee. Any cancellation within 2 hours of the shoot or once the photographer has arrived will be subject to 100% of the package amount.
Agents and homeowners are expected to have the property cleaned and staged prior to the photo shoot. If the property is not ready to be photographed you should make every effort to reschedule 24 hours prior to the shoot. inzpire Photography is not responsible for staging, cleaning, decluttering, or landscaping.
We are not a staging service, cleaning service, or a landscaper...we are a photography service. Even though we do not mind moving/ removing small manageable items at our own discretion, there will however be a "staging/convenience fee" added if we are required to move or prepare a property before photography can commence. There is by no means an obligation by the photographer to do these actions. Please view our Pre-Shoot Checklist.
We photograph in all weather except for rain. If rain is present the client will be given the option to reschedule at no additional charge. Weather should however be evaluated several days prior to the shoot to prevent any rescheduling. The weather policy does not cover rescheduling or cancelling under 24 hours due to cloudy weather or lack of sun (rain must be present in order for the fee to be waived).
A minimum of 72 hours notice is recommended when scheduling for a property shoot. A request for photos to be completed and delivered in under 12 hours from time of shoot is subject to an additional $50 rush fee.
Should the property require more than 35 minutes travel, an additional cost of $50 will apply, this can be negotiated at the time of booking as distances may vary and the previous shoot or next shoot may be in the near vicinity. A larger travel surcharge will be assessed for properties significantly out of that range. Properties in rural or remote areas may be subject to additional travel fees depending on the extent of the distance from a major paved roadway.
We generally don't do weekend shoots but should this be absolutely unavoidable for your client and we are available, then this will be quoted separately. Note that these will be charged at double the standard daily price rate(s).
For most standard real estate shoots, inzpire Photography guarantees a 24 hour or less turn around time. Some photo shoots of larger properties or with extensive editing/special requests, such as luxury, twilight, and aerial videography may take up to 48 hours. inzpire Photography will also maintain a photo backup and provide access to the final images for up to 60 days after the photos are delivered to the client via download link. After 60 days, inzpire Photography cannot guarantee the photos will be available, however if they are, there will be a $30 retrieval fee if the client requests another copy. We highly recommend that you download the photos/video immediately after receiving the final downloadable link(s) as this will ensure no future issues or retrieval fees.
